1. Acceptance of Terms

By accessing and using this service, you accept and agree to be bound by the terms and provision of this agreement.

2. Use License

Permission is granted to temporarily use this service for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title.

Under this license you may not:

  • Modify or copy the materials
  • Use the materials for any commercial purpose
  • Attempt to decompile or reverse engineer any software contained in the service
  • Remove any copyright or other proprietary notations from the materials
3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms.

You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password.

4. Cookies and Authentication

4.1 What Are Cookies

4.4 Cookie Lifespan and Deletion
Authentication cookies are automatically deleted in the following scenarios:

We do not use tracking, analytics, or advertising cookies. The only cookies we use are strictly necessary authentication cookies required for the service to function.

5. Content

Our service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material. You are responsible for the content that you post to the service.

6. Audio Content and Voice Data Processing

6.1 Personal Data and Biometric Information
Your voice is classified as a biometric characteristic and personal data under GDPR (General Data Protection Regulation), as it can be used to identify or uniquely associate you as an individual. By using LumaEcho's audio recording features, you acknowledge that you are providing biometric data.

6.2 Consent and Legal Basis
By creating and uploading audio content (posts, echoes, or replies), you provide your explicit consent (Art. 6 Para. 1 lit. a GDPR) for us to process, store, and make available your voice recordings according to the privacy settings you choose. This consent is:

  • Voluntary: You are not required to create audio content to use other features of the service
  • Informed: You are aware of how your data will be processed
  • Revocable: You can withdraw consent at any time by deleting your audio content

6.3 Purpose Limitation
We collect and process your audio data solely for the following purposes:

  • To enable you to share voice messages with other users
  • To store your audio content for playback by authorized users
  • To provide social audio networking features (posts, echoes, replies)

6.4 Storage Duration and Deletion
Your audio recordings are stored according to the following rules:

  • Audio content is stored indefinitely until you manually delete it
  • You can delete individual posts, echoes, or replies at any time through the platform interface
  • Upon account deletion, all your data and audio content will be immediately and permanently deleted

6.5 Data Security
We implement industry-standard security measures to protect your audio data:

  • All audio transmissions are encrypted using HTTPS/TLS
  • Audio files are stored on secure servers with restricted access
  • Access to audio content is controlled by authentication and authorization mechanisms
  • Regular security audits and updates are performed

6.6 Your Rights
Regarding your audio data, you have the right to:

  • Access all audio content you have created
  • Delete any or all of your audio recordings at any time
  • Withdraw your consent by deleting your content or account
  • Request information about how your voice data is processed
  • File a complaint with a data protection authority

7. Third-Party Services

To provide our services, we use the following third-party service providers:

OpenAI Whisper API
We use OpenAI's Whisper API to automatically transcribe your audio recordings into text. By uploading audio content, you acknowledge and consent that:

  • Your audio files will be transmitted to OpenAI (a US-based company) for transcription
  • The transcribed text will be stored in our database for search and accessibility features
  • OpenAI processes data according to their Privacy Policy and Terms of Use

Cloudflare
We use Cloudflare for security and bot protection during authentication. Cloudflare may process:

  • IP addresses and request metadata during login/registration
  • Security-related information for DDoS protection and fraud prevention

Cloudflare processes data according to their Privacy Policy

DeepL API
We use the DeepL API to translate transcriptions of audio content into other languages. By requesting a translation, you acknowledge and consent that:

  • The text transcription of the audio content will be transmitted to DeepL SE for translation
  • DeepL SE is a German company that processes data within the EU
  • DeepL processes data according to their Privacy Policy

Data Processing Agreements
We maintain Data Processing Agreements (DPAs) with all third-party processors to ensure GDPR compliance and protect your data. For international data transfers (e.g., to the USA), we use Standard Contractual Clauses approved by the EU Commission.

8. Prohibited Uses and Content

You may not use the service:

  • In any way that violates any applicable national or international law or regulation
  • To transmit any unsolicited or unauthorized advertising or promotional material
  • To impersonate or attempt to impersonate the company, a company employee, another user
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the service

Zero Tolerance for Hate Speech and Discrimination
LumaEcho strictly prohibits any content or behavior that constitutes hate speech, harassment, or discrimination. You may not create, upload, or share audio content (posts, echoes, replies) or other material that:

  • Promotes, incites, or threatens violence or hatred against individuals or groups based on:
    • Race, ethnicity, or national origin
    • Religion or religious beliefs
    • Gender, gender identity, or gender expression
    • Sexual orientation
    • Disability or medical condition
    • Age
    • Immigration status
    • Caste
  • Uses dehumanizing language or imagery against protected groups
  • Promotes or glorifies hate symbols, supremacist ideologies, or terrorist organizations
  • Denies well-documented violent events (e.g., Holocaust denial)
  • Harasses, bullies, or intimidates other users
  • Contains threats of violence or harm against any person or group
  • Promotes self-harm or suicide

Enforcement
Violations of this policy will result in immediate action, including but not limited to:

  • Removal of offensive content
  • Temporary or permanent suspension of your account
  • Reporting to law enforcement authorities where legally required

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

10. Limitation of Liability

In no event shall the company, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
